Law on Organ Transplantation in Asian-Pacific Countries(Ⅲ)

Abstract
|
|
|
1. Human Organ Transplantation Act was promalgated by President´s Decree No. 2206 on June 19, 1987.
Republic of China was the first confucian country where brain death was legally accepted in Human Organ Transplantation Act in 1987.
Retrieval of organ from cadaver or living donor is permitted (Article 1).
Organ transplantation by cadaver donor organ may be done only after pronouncement of death by the attending physician, and in case of brain death regulations on determination of brain death by the National Health Ministry must be observed (Article 4).
Extirpation of organ from cadaver donor may be done after written consent by the donor or next of kin is obtained. Oral consent by the deceased must be supported by more than two physicians with written documents (Article 6).
Human Organ Transplantation Regulations
Total 11 Articles are included. Health Ministry designated the following organs to be transplanted, i.e. kidney, liver, pancreas, heart, lung. bone, bone marrow and cornea (Article 2)-
The order of priority of the person who may execute a donation of organ is as follows ; (D spouse (2 son or daughter 03 either parent ® brother or sister 05 either grand parent either great gra_3 parent (7 either parent in law (Article 4).
3. Determination of Brain Death Regulation
The regulations ´ consist of 1D Prerequisites ⓒ Exclusion of reversible coma (3 Comatose patient on respirator ® Brain stem reflex test with confirmation test after a certain period of time. (5 Determination of Brain death ⓒ Brain death determination by neurologist, neurosurgeon, anesthesiologist and physicians who are trained in brain death diagnosis and licensed. Attending physician with two qualified physicians (7 Certain facilities and equipments of the hospital.
